An in-depth inquiry into the First Amendment, including the doctrine and theory of free expression, association, assembly, and religion. About half of the semester will be devoted to free-speech doctrines, including rules related to content- and viewpoint-based regulation of speech, the regulation of speech in criminal and tort law, limits on the places available for speech and assembly, categories of unprotected speech, campaign finance reform and commercial speech, and rights against compelled speech and association. The second half of the semester will be devoted to religious liberty under the First Amendment, press freedom, and free association and assembly.
